This Privacy Policy describes how Simpl Media ("we," "us," "our") collects, uses, and shares information when you use curate.ai (the "Service"), available at curate-hq.com and through our mobile applications.
Our AI communication system ("Atlas") processes the content of messages between you and your leads and clients, including inbound replies routed through your Atlas reply address, in order to draft responses, qualify leads, generate project scopes, and manage bookings on your behalf.

The Service uses artificial intelligence provided by Anthropic, PBC to power Atlas. When Atlas drafts messages, scores leads, generates scopes, or analyzes replies, relevant conversation content and profile data is transmitted to Anthropic's API for processing. Anthropic processes this data pursuant to its commercial terms and does not use API data submitted through our integration to train its models, per Anthropic's commercial API terms.
You are responsible for reviewing AI-generated content before it is sent (or configuring auto-send at your own discretion) as described in our Terms of Service.

We may also share information: (a) with your consent or at your direction (e.g., when Atlas sends a message to your lead, or when your client accesses their client portal); (b) to comply with law, regulation, legal process, or governmental request; (c) to protect the rights, property, or safety of Simpl Media, our users, or the public; or (d) in connection with a merger, acquisition, or sale of assets, in which case this policy will continue to apply to your information.

If you are a client of a curate.ai user and access a client portal link, we collect limited information about your portal activity (file downloads, revision requests, and the notes you submit) solely to deliver that activity to the creator you are working with. The creator you are working with — not Simpl Media — is responsible for the relationship with you. Questions about your project or data should be directed to your creator.
Users of the Service may input, upload, or generate information about their prospective and current clients ("Lead Data"). With respect to Lead Data, the user is the party responsible for ensuring a lawful basis to collect and use that information, including compliance with applicable anti-spam and privacy laws (such as CAN-SPAM). We process Lead Data solely on the user's behalf to provide the Service. If you believe your information has been entered into our system and wish to have it removed, contact us at [CONTACT EMAIL] and we will pass the request to the relevant user and/or remove the data as required by applicable law.
We retain your information for as long as your account is active or as needed to provide the Service. You may delete your account at any time, after which we will delete or de-identify your personal information within a reasonable period, except where retention is required for legal, tax, or dispute-resolution purposes. Payment records are retained as required by financial regulations.
We implement reasonable technical and organizational measures to protect your information, including encryption in transit, row-level security on our database, and access controls. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
